The Veterans Affairs Department would be barred from submitting a veteran’s personal information to the National Instant Criminal Background Check System solely because the department appoints a fiduciary to manage the veteran’s federal benefits under H.R. 1041.

The bill would prevent veterans who require a financial fiduciary from being listed in the Justice Department’s NICS background check system for firearm purchases unless there is a court order or a similar judicial finding that the veteran is a danger to themselves or others.
