Stability AI, Midjourney Inc., and DeviantArt Inc. each asked a California federal court to dismiss a first-of-its-kind copyright infringement class action accusing the companies of unlawfully using artists’ work to train artificial intelligence art generator tools.
In a series of separate motions filed Tuesday, the three companies generally argued that Sarah Andersen, author of the web comic “Sarah Scribbles,” along with fellow artists Kelly McKernan and Karla Ortiz failed to adequately allege their claims. The artists claimed the companies downloaded and used billions of copyrighted images without obtaining the artists’ consent or compensating them.
