Wisconsin School Fails to Beat Nonbinary Student’s Title IX Suit

A nonbinary student can pursue their Title IX suit alleging the Rhinelander, Wis., school district discriminated against them based on their gender identity.

Nonbinary students are protected under Title IX in the same sense that transgender students are, since they don’t conform to stereotypes of the sex their assigned at birth, Judge William M. Conley of the US District Court for the Western District of Wisconsin said in a Thursday order denying the bulk of a defense motion to dismiss.
