Alleged government retaliation will again be a topic of discussion at the U.S. Supreme Court next term.
The high court held June 18 that Fane Lozman could proceed with his retaliatory arrest suit against the City of Riviera Beach, Fla., even though there was probable cause for his arrest.
Like Lozman, Russell Bartlett sued officials claiming his arrest was retaliatory. Courts likewise found probable cause.
Both sides in Bartlett’s case acknowledge that Lozman affects the outcome—the question is whether any differences here lead to a different result.
