Supreme Court to Consider Second Chances for Federal Prisoners

The Supreme Court added a habeas case to its docket regarding the fallout from intervening decisions.

The question for the justices in the case granted on Monday is whether inmates should get a second chance to challenge the legality of detention based on a revised Supreme Court view of certain case law.

Typically, federal inmates are allowed only one shot at challenging their incarceration via a habeas petition. But there’s a catchall, or a saving clause, for when habeas is “inadequate or ineffective to test the legality of” detention.
