Ophthalmologist Loses Bid For New Trial in Criminal Fraud Case

A former licensed ophthalmologist failed to convince the Eleventh Circuit on Monday that he should have been allowed to provide rebuttal testimony about the efficacy of his micropulse laser treatment during his Medicare fraud trial.

The rebuttal testimony that David Pon wanted to present would have addressed only about eleven of 2,000 pages, or about one half of one percent, of the testimony presented at trial, Judge Ed Carnes said for the U.S. Court of Appeals for the Eleventh Circuit.
