DUI Conviction Stands in Iowa Despite No Private Call to Lawyer

An Iowa man lost his drunk driving conviction and sentence appeal even though he was denied a confidential phone call with his attorney before consenting to a blood alcohol test at the time of his arrest, according to a state top court ruling published Friday.

Matthew Sewell was arrested in 2019 after being found asleep, apparently intoxicated, in his vehicle. After being taken to the Dickinson County Jail, Sewell was allowed to contact an attorney using the jail landline before agreeing to give a chemical breath test sample.
