Uniloc Lacks Standing In Patent Suit Against Apple, Court Says

Uniloc Luxembourg SA didn’t have legal standing to sue Apple Inc. over a rechargeable battery patent, a California federal district court judge ruled, throwing out the patent holding company’s infringement lawsuit.

Uniloc lacked standing because it gave Fortress Investment Group LLC broad rights in the patent when Uniloc defaulted on a loan, U.S. District Judge William Alsup said. Uniloc patents were collateral for the loan.

“The plaintiffs’ patent licensing scheme divested them of exclusionary rights and, thus, of Article III standing,” Alsup wrote in an order dismissing the case.
