U.S. Supports Deaf Woman in SCOTUS Disability Bias Damages Suit

The U.S. Supreme Court should clarify that damages for emotional harm are available to victims of intentional discrimination suing under federal disability bias laws, the U.S. told the nation’s top court.

The federal government is supporting Jane Cummings in her bid to have the Supreme Court overrule a decision by the U.S. Court of Appeals for the Fifth Circuit, which held that she didn’t have a claim for emotional distress damages under Rehabilitation Act Section 504 or Section 1557 of the Affordable Care Act.
