Trump-Era Endangered Species Rules Reinstated by Ninth Circuit

A federal district court erred in vacating Trump-era Endangered Species Act regulations that changed how the agency classified endangered or threatened species when it bypassed ruling on the legal validity of the regulations.

The rules changed how the government designates critical habitat for at-risk plants and animals, ended a longtime practice of automatically extending the same protections to threatened species as to endangered species, and allowed agencies to conduct some economic analysis of protections.
