Third Circuit Affirms Block on Birth Control Mandate Exemptions

The Trump administration may not enforce rules allowing employers with religious or moral exemptions to opt out of providing insurance plans that pay for birth control, the Third Circuit ruled.

Pennsylvania and New Jersey are likely to succeed on claims that the U.S. Health and Human Services Administration, the Labor Department, and the Treasury Department lacked authority to adopt exemptions to Obamacare’s requirement that employer plans cover contraceptive care, the U.S. Court of Appeals for the Third Circuit said July 12.
