Texas Judge’s Courtroom Invocations Unconstitutional, Court Says

A Texas judge’s decision to open court proceedings with an invocation violates the separation of church and state and “makes a mockery of both religion and law,” a federal district court said.

John Roe, a Texas attorney and member of Freedom From Religion Foundation Inc., sued Wayne Mack for instituting a prayer ceremony in his courtroom. The situation pressured attendees to participate and presented the judge as religiously inspired, the U.S. District Court for the Southern District of Texas said in a Thursday opinion granting the foundation summary judgment.
