Texas Judge Can’t Escape Suit Over Courtroom Prayer Practice

A Texas justice of the peace lost his bid to escape a lawsuit alleging he instituted an unconstitutional courtroom prayer practice.

In the most recent version of Judge Wayne Mack’s program, after the docket is called the bailiff or court clerk gives a brief statement that a prayer will follow and anyone desiring to leave the courtroom may do so, according to plaintiffs Freedom From Religion Foundation Inc. and Montgomery County attorney “John Roe.” The court officer sometimes, but not always, informs those in attendance that leaving the courtroom won’t affect the outcome of their cases, the plaintiffs say.
