State Liability for Federal Wage Violations Heads to Arizona

The Ninth Circuit asked the Arizona Supreme Court on Wednesday to determine whether the state has agreed to damages liability in cases where a public agency violated federal wage and hour standards.

Plaintiff Marcie Redgrave, an at-home caretaker for a Medicaid program beneficiary, claims that the Arizona Department of Economic Security’s Division of Developmental Disabilities hasn’t properly paid her for all the hours she has worked.

Redgrave wants to represent a group of other “independent providers,” or independent contractors, who believe the state agency violated federal wage and hour regulations in its compensation calculations.
