South Bend Police Officer Must Face Lawsuit Over Fatal Car Crash

The estate of a woman killed by a speeding South Bend, Ind., police officer is entitled to proceed with its lawsuit against both the officer and the city, because it adequately alleged the officer acted with deliberate indifference to the risk he caused, the Seventh Circuit said Wednesday.

Early one morning in 2018 a team of South Bend officers radioed that they’d spotted a vehicle speeding in their patrol area and planned to stop it. They never signaled the stop was an emergency or requested assistance from other officers.
