SCOTUS Deep Dive: The Shadow Term (PODCAST)

The 2018 Supreme Court term is at its mid-point with the justices on break until Feb. 19.

Bloomberg Law looks at how the term is shaping up, and notes that while the argued cases have been low-profile, the court has been grabbing headlines with its summary actions. These include issues like the census, the Trump administration’s asylum ban, and the prohibition on transgender military service.

Law professor Josh Blackman joins the podcast to discuss drawbacks of considering such high-profile issues on what’s frequently referred to as the “shadow docket.”
