Scooter Company Loses Bid to Split California PAGA Labor Claim

An electric scooter company is the latest in a series of app-based platforms to fail to convince California courts to force arbitration of claims filed by workers on behalf of the state’s labor agency.

San Francisco-based Skip Transport Inc. said Thomas Schofield, who worked for Skip recharging scooter batteries, must arbitrate his claims that the company misclassified its workers as independent contractors.

Under California’s Private Attorneys General Act, aggrieved employees are empowered to seek civil penalties for labor code violations on behalf of the state’s Labor and Workforce Development Agency.
