San Bernardino Must Face Claims Inspector Framed Man for Murder

The county of San Bernardino, Calif., and an investigator with the sheriff’s crime lab will face reinstated civil rights claims by a man who alleges he was framed for the murder of his wife, after the Ninth Circuit ruled Friday that credible evidence of fabrication makes it unnecessary to show the investigator had a motive to do so.

Plaintiff William Richards raised a triable issue as to whether investigator Daniel Gregonis deliberately planted blue fibers from Richards’ shirt under his deceased wife’s fingernail, the US Court of Appeals for the Ninth Circuit said.
