Rite Aid Wins Delay of Generic Drug Price Case Pending Appeal

Rite Aid Corp. won’t have to litigate claims over alleged excessive charges for generic drugs while it appeals a decision denying its motion to force the plaintiffs to arbitrate the case, a federal court in California said.

The retail pharmacy raised serious legal questions over its right to arbitration and would be irreparably harmed if forced to go to trial before its appeal is completed, the U.S. District Court for the Southern District of California said Thursday.
