Refusing Inmate’s Wheelchair Request Leaves Jail Facing ADA Suit

An inmate who was denied a wheelchair after having surgery on her leg may proceed with her Americans with Disabilities Act claim against the jail she was in after her arrest, the Fifth Circuit said Jan. 3.

April Cadena presented sufficient evidence for a reasonable jury to find the jail denied her a reasonable accommodation, the opinion by Judge Stephen A. Higginson said.

Cadena was arrested on an outstanding warrant three days after having surgery to repair a broken tibia. She was in a wheelchair at the time, because her doctor determined she couldn’t put weight on the leg or...
