Parents Beat California’s Private School Closure to Fight Covid

California violated the due process rights of parents who send their children to private schools by ordering them closed to combat the spread of the Covid pandemic, the Ninth Circuit said.

But it was okay for the state order all of its public schools closed for the same reason, the opinion by Judge Daniel P. Collins said. There is no constitutional right for parents of public school students to have the state affirmatively provide an education in any particular manner, it said, upholding the almost exclusive online format California adopted for public schools.
