North Dakota Clinic Won’t Face India-Born Oncologist’s Bias Suit

An India-born oncologist failed to win reinstatement of federal race bias claims stemming from an indefinite suspension, as the Eighth Circuit said a North Dakota Clinic legitimately removed him from the practice because of an inability to get along with colleagues.

Jayaram Bharadwaj failed to show the clinic’s reasons for removing him from the practice were a pretext for discrimination, the U.S. Court of Appeals for the Eighth Circuit said Friday.

Bharadwaj was with the Mid Dakota Clinic in Bismarck, N.D., for four-and-a-half years, the last two years as a shareholder.
