Nonprofit Asks Top Texas Court for Lower Cap on a Jury’s Award

Texas Supreme Court justices on Thursday questioned what makes a community center a government entity, and whether that entity would be a state or local, in a case that could cause one such organization to lose out on a $100,000 statutory cap on damages.

Attorneys for the Gulf Coast Center, a nonprofit that provides mobile health services in southern Texas contend their client didn’t forfeit that cap in a personal injury case it lost at trial because a section of the Texas Health & Safety Code stipulates that community centers are a unit of local government.
