No Qualified Immunity for Prosecutor Charged With Misconduct

A Nevada district attorney was reprimanded for his misconduct after failing to convince the state’s highest court that he was entitled to qualified immunity and that the state bar had no jurisdiction over him.

“An attorney cannot avoid professional discipline by asserting qualified immunity,” the Nevada Supreme Court said September 23.

“Further, even if an attorney is an elected official, the State Bar has authority to investigate and prosecute alleged violations of the Rules of Professional Conduct,” the court added.
