No Immunity for Cop Accused of Abusing Assault Victim

A lawsuit claiming a police officer touched and photographed a sexual assault victim for his own gratification under the guise of collecting evidence can go forward, the U.S. Court of Appeals for the Third Circuit held Aug. 22.

The alleged conduct shocks the conscience and violated a woman’s constitutional right to bodily integrity, the court said in an opinion by Judge Julio M. Fuentes.

The district court erred in holding that the alleged conduct didn’t violate clearly established law, the court said.
