No Federal Relief on Death Row Inmate’s Ineffective Lawyer Claim

A death row inmate in Arkansas failed to convince the Eighth Circuit that he’s entitled to federal relief, even though his trial and post-conviction lawyers mishandled his case.

Mickey Thomas initially filed for state post-conviction relief, claiming his trial lawyer didn’t properly investigate his case and mental health issues. After that petition was denied, Thomas appealed to the state supreme court, claiming his trial counsel should have objected to his trial venue being changed and called more witnesses, but he didn’t restate the investigation issues.
