News Ink Manufacturer Gets Most Claims Revived in Explosion Suit

Sun Chemical Corp. will get a new chance to pursue claims against a suppression system maker over an explosion at a New Jersey manufacturing facility after the Third Circuit revived the case in part Friday.

Sun, which made black news ink at the East Rutherford plant for almost a century before the explosion, appealed the lower court’s grant of summary judgment to Fike Corp. and Suppression Systems Inc. Four of Sun’s five consumer fraud claims aren’t subsumed by a state products liability law and deserve another look, the U.S. Court of Appeals for the Third Circuit said.
