Montana Law Expanding Firearms on College Campuses Struck Down

Montana’s attempt to expand open and concealed carry of firearms on state university campuses fell flat when the state’s top court ruled Wednesday that the Montana Board of Regents has sole authority to set firearm policy on university property.

The Board of Regents of Higher Education has exclusive authority under the state’s constitution to regulate firearms on college campuses, the Supreme Court of Montana held in an opinion by Justice Laurie McKinnon. A 2021 state law purporting to override Board-imposed campus firearm regulations is an unconstitutional infringement on the Board’s responsibility to oversee the university system, the court said.
