Molina Healthcare Fraud Allegations Will Go Back to Trial Court

A whistleblower will have another chance to allege Molina Healthcare of Illinois Inc. violated the False Claims Act by misrepresenting that it was providing skilled nursing facility services under a contract with Illinois Medicaid, the Seventh Circuit ruled Thursday.

Thomas Prose, the founder of Molina subcontractor GenMed, showed that a district court improperly concluded that his complaint lacked sufficient detail, Judge Diane P. Wood of the U.S. Court of Appeals for the Seventh Circuit said in a split decision to reverse and remand.
