Mississippi Emergency Patient Gets Redo in Fee Disclosure Suit

A Mississippi hospital will have to defend its alleged failure to disclose facility fees charged to emergency room patients, after the Fifth Circuit held that state law may impose a duty of disclosure on it.

Kimberly Henly can move forward with a potential class action seeking a declaratory judgment that hospitals in the state must tell emergency room patients about charges added on top of line-item charges for specific treatments, the US Court of Appeals for the Fifth Circuit said.
