McDonald’s Biometric Information Privacy Act Claims Remanded

Several biometric privacy claims levied against McDonald’s Corp. are remanded to state court because the complaint doesn’t adequately plead concrete, particularized harm for those claims, an Illinois federal judge ruled.

Plaintiff Shannon Carpenter thus lacks Article III standing to bring those alleged violations of the Illinois Biometric Information Privacy Act in federal court, Judge Charles R. Norgle wrote in an opinion filed Monday in the U.S. District Court for the Northern District of Illinois.

Attorneys representing McDonald’s didn’t immediately respond to a request for comment.
