Maryland Construction Workers Win Revival of Bus Time Wage Suits

Maryland construction workers who want payment for time spent travelling on employer buses between parking lots and MGM National Harbor casino building sites aren’t blocked by a federal law on compensable work, the state’s top court said.

The workers filed two class actions seeking unpaid wages and overtime under state law for the two hours they spend traveling between employer-directed parking areas and construction sites on average workdays. A federal law on pre- and post-workday travel hasn’t been adopted or incorporated into state law, so it doesn’t doom their claims, the Maryland Court of Appeals said Wednesday.
