Mapmaker’s Speech Suit Against Mississippi Surveyor Law Revived

A First Amendment suit challenging Mississippi’s licensing requirement for surveyors, as applied to a company that converts legal descriptions of property into computer generated drawings and sells them to commercial banks, was revived by the Fifth Circuit.

The district court had dismissed the suit, saying state licensing requirements aren’t subject to the First Amendment. But the opinion by Judge Stuart K. Duncan said that holding was contrary to the U.S. Supreme Court’s analysis in Nat’l Inst. of Family & Life Advocates v. Becerra.
