Kohl’s Must Face Out-of-State Wheelchair User’s ADA Lawsuit

Kohl’s must face an ADA lawsuit brought by a wheelchair user who said the retail giant’s restrooms at two Michigan locations are inaccessible, despite the fact that the plaintiff lives in Arizona and has only been to the locations one time, the Sixth Circuit ruled.

Daimeon Mosley sued Kohl’s under the Americans with Disabilities Act in an effort to bring the bathrooms into compliance with the law, but the case was tossed by the district court, which found he lacked standing because it was unlikely he’d return to them.
