Justices Weigh Guns and Drugs in Florida Sentencing Appeal (1)

The latest arguments over a much-litigated sentencing law were aired at the Supreme Court, with the justices divided over whether Florida’s outlier drug laws can trigger federal mandatory minimum prison terms for gun convicts.

Though the government may well prevail in this round of Armed Career Criminal Act litigation, justices including Neil Gorsuch had tough questions for both sides at oral argument on Tuesday. He scrutinized the defense position but also worried about “draconian” implications of the Justice Department’s argument.
