Justices Rebuff Agency in Separation of Powers Decision (1)

The U.S. Supreme Court sided with those seeking Social Security benefits in the latest in a string of separation of powers cases seeking greater accountability of the executive branch.

In a unanimous ruling on Thursday, the high court reversed lower courts that found claimants forfeit challenges to the structure of the Social Security Administration if they wait to make them for the first time in federal courts.

Appellate courts erred in requiring those seeking benefit claims to exhaust that issue before the agency, Justice Sonia Sotomayor wrote for the court.
