Ingevity Loses First Round in Patent Case Over Fuel Systems

Ingevity patent for canister system to control evaporative emissions from automobile fuel tanks is invalid, U.S. International Trade Commission Judge Cameron Elliot said in a notice posted on the agency’s electronic docket.

  • Judge’s findings are subject to review by full commission, which has the power to block imports of products that violate U.S. patent rights
  • Elliot found Mahle, Kuraray and Nagamine infringed the patent, which would be moot if commission upholds the invalidity finding
    • Kuraray and Nagamine make the canisters in Japan and import them for sale to Mahle, according to the complaint
