Indiana Abortion Clinic May Stay Open During Licensing Fight

An abortion provider may continue operating a South Bend, Ind., clinic that provides only medication abortions while fighting the state’s licensing requirements, the Seventh Circuit said Aug. 22.

Whole Woman’s Health Alliance has shown it likely will succeed on its claim that Indiana’s licensing requirements for medication-only clinics, as applied to the South Bend clinic, violate the 14th Amendment’s due process and equal protection clauses, the U.S. Court of Appeals for the Seventh Circuit said. The court affirmed an injunction that allowed the clinic to open.
