Hispanic Police Lieutenant’s Race Bias Claim Reinstated

A Hispanic Binghamton, N.Y., police lieutenant who says he was racially harassed and passed over for promotion in favor of a less qualified White candidate provided enough detail to support a bias claim, the Second Circuit said Wednesday in reinstating part of his civil rights suit.

But Alan Quinones’ claim that the department retaliated against him for voicing concerns about discrimination was properly dismissed because he didn’t link the alleged retaliation to protected activity, the U.S. Court of Appeals for the Second Circuit said.
