Georgia Tech Beats Ex-Student’s Suit Alleging ADA Retaliation

Georgia Tech’s board of regents escaped a former student’s that claims the school retaliated against him in violation of the Americans With Disabilities Act, after the Eleventh Circuit Thursday held that his claims failed on the merits or were time-barred.

Lewis Atchison enrolled in Georgia Tech in 1997 and received testing accommodations for his attention deficit hyperactive disorder and dyslexia. He had multiple disciplinary issues, was suspended twice for violent conduct, and was ultimately expelled in 2006 for bringing unauthorized materials into his exams.
