Gay Nigerian Man Fearing Torture Gets New Asylum Hearing

A gay Nigerian man won a new hearing to determine whether he may stay in the U.S., after the Ninth Circuit on Wednesday said an immigration agency wrongly found his asylum application frivolous and failed to consider evidence that he would be tortured if he returned.

Peter Donatus Udo asserted a fear of persecution or torture in Nigeria based on his status as a gay man, threats made to him and his family, and physical harm he suffered after being discovered having sex with his boyfriend in a hotel in 2015.
