Firing of Public Defender Who Insulted Boss During Podcast Valid

A First Amendment suit by an assistant public defender, who was fired the day after her campaign ended to replace her boss because she insulted him on a podcast during her campaign, must be dismissed, a federal court in Florida said.

During the podcast, Ruby Green, who is Black, said that retiring Broward County public defender Howard Finkelstein didn’t hire Black assistants, neglected his job, treated his employees like “trash,” and wouldn’t let her march in a Black Lives Matter rally. She also made a reference to Finkelstein’s previous drug use.
