Multiple challenges to the Federal Energy Regulatory Commission’s authorization of the Constitution natural gas pipeline should be dismissed because the pipeline developer canceled the project, the agency told the Second Circuit.
FERC’s authorization of the project also lapsed Dec. 2, so all appeals of the agency’s orders are moot, according to its Monday filing in the U.S. Court of Appeals for the Second Circuit.
The agency issued a “certificate of public convenience and necessity” to Constitution Pipeline Co. LLC in December 2014. The project would transport natural gas between Pennsylvania and New York.
