FERC Must Revisit Rule Allowing ‘Pancaked’ Kentucky Power Rates

Louisville Utilities must wait for further FERC review before it stops protecting customers in Kentucky from duplicate electricity charges, also known as pancaked rates, after D.C. Circuit ruled that the order allowing the change was improper.

The Federal Energy Regulatory Commission did explain that customers would see a competitive market without depancaking, according to the US Court of Appeals for the D.C. Circuit. But the agency completely ignored the “significant effect” duplicate charges will have on customer rates, the court said.
