Felon-Firearm Ban Applies to Pennsylvania DUI Offender

A Pennsylvania man convicted of misdemeanor drunken-driving under state law lost his Second Amendment challenge after the Third Circuit ruled Friday that a federal statute prohibiting felons from possessing firearms isn’t unconstitutional as applied to him.

Raymond Holloway Jr.’s DUI misdemeanor conviction constitutes a serious crime that requires disarmament, the U.S. Court of Appeals for the Third Circuit held. The court reversed the Middle District of Pennsylvania’s order granting Holloway summary and declaratory judgment, and an injunction barring the state government from enforcing the law against him.
