Federal Workers’ Suit Over Advice About Trump Impeachment Moot

Claims by a federal employee union that opinions issued by the Office of Special Counsel advising that federal employees shouldn’t use “resistance” and "#resist” when speaking about then-president Donald Trump’s first impeachment are moot, the Fourth Circuit said Friday.

The OSC is charged with enforcing the Hatch Act, which is designed to prevent partisan politics from infecting the federal workforce. It said the Hatch Act prohibited advocacy for or against the impeachment and use of the two phrases could be considered political activity.

The American Federation of Government Employees sued under the First Amendment to enjoin enforcement of the opinions. ...
