EEOC’s U.S. Soccer Pay Stance Gets Early Fourth Circuit Tryout

A regional sales manager for a medical devices company and the EEOC could provide a big assist to the U.S. women’s soccer team if they can convince a Richmond, Va.-based federal appeals court that she may have been underpaid based on sex.

At least two of the judges on the three-judge panel seemed to accept during oral argument Wednesday the Equal Employment Opportunity Commission’s view that a lower court used the wrong test when it rejected Tracy Sempowich’s Equal Pay Act claim against Tactile Systems Technology Inc.
