Deputy Who Prevented CPR on Man Who Attempted Suicide Faces Suit

A jury must decide whether a sheriff’s deputy who prevented qualified bystanders from performing CPR on a man who attempted suicide by hanging himself violated the man’s clearly established due process rights, the Eleventh Circuit said.

The trial court denied Marion County Florida Sheriff’s Deputy Gregory Spicher qualified immunity in the suit filed by Anthony Ybarra’s mother, Jolene Waldron, after her son died. It reasoned Ybarra was alive and in grave medical need, Spicher didn’t assess Ybarra’s condition when he arrived, and it should have been obvious CPR was still needed.
