Daikin America Denied Appeals Court Look at PFAS Pollution Suit

Daikin America Inc. must defend a proposed class action seeking to hold it and other chemical manufacturers liable for PFAS water contamination in northwestern Georgia, a federal judge in the state ruled, refusing the chemical-maker’s request for permission to make a mid-case appeal.

The US District Court for the Northern District of Georgia interpreted and applied state case law in an “admittedly novel environmental context” when it rejected the company’s motion to dismiss negligence and public nuisance claims in March, the court acknowledged.
