Court Punts on VA Threat to Cut Off Online University’s Funding

A Department of Veterans Affairs letter threatening to cut off payments to Ashford University for online courses taken by veterans isn’t reviewable by a federal appeals court, the Federal Circuit ruled Tuesday.

The letter didn’t announce a general rule, the appeals court said. Rather, it’s part of an “adjudication” that can be reviewed by the Board of Veterans’ Appeals and the Veterans Court, Judge Timothy B. Dyk said for the U.S. Court of Appeals for the Federal Circuit.

Ashford can take its case there, even though it isn’t a veteran or an individual natural person, Dyk said.
